Now it’s the Endangered Species Act itself that is endangered.
Although it received overwhelming bi-partisan support when enacted in 1973*, but for years a political football, the Endangered Species Act (ESA) faces an existential challenge. The current administration this week announced final rules interpreting the law in ways that may well eviscerate it; for example, by requiring a consideration of economic factors before listing a species under the act. Critics claim these changes violate the law itself. Expect a court challenge, both from major nonprofit organizations and from various state Attorneys General (MA and CA have said they will sue as of today).
There will be plenty of time to discuss and dissect the new rules, their implication and their legality. But for today, it’s important to visualize what is at stake here. Let’s take a look at Michigan. Eighteen species of animals found in Michigan currently receive federal protection under the ESA, 13 of which are endangered and 5 threatened (designated “E” and “T” on the images below). Three of the endangered species are so rare that the government’s own website could find no image in existence for: the Mitchell’s satyr butterfly, Snuffbox mussel and Poweshie skipperling.
It’s worth taking a look at the US Fish and Wildlife Service website, and look up the animals (and plants) currently protected under a law that may look very different, and provide fewer protections for, species needing it in the not so distant future.
